Airline baggage insurance conditions

1. GENERAL PROVISIONS, SUBJECT MATTER OF THE TERMS AND CONDITIONS

  1. The POLICYHOLDER / INSURED shall pay the INSURER the insurance premium, and the INSURER, upon the occurrence of an insured event, shall pay the BENEFICIARY the insurance indemnity in the amount, within the timeframe and under the conditions stipulated in the Insurance Contract, concluded in compliance with the applicable legislation of the Republic of Moldova and the Insurer's Insurance Terms and Conditions.
  2. Insurance BENEFICIARY: the passenger, the owner of the Baggage.
  3. The Insurer undertakes to insure the Beneficiary's Baggage transported by air by the Airline.
  4. Characteristics of the transported cargo:
    Insured Baggage: all tourist baggage (including its contents, subject to the exclusions specified in Chapter 10 of this Contract) closed with a zipper or lid (travel bag, suitcase, trunk, trolley case), intended for the transportation of items with a combined weight of more than 5 kilograms, with which the Beneficiary travels during the air travel period.
    • type of transportation and transportation characteristics – air transportation, according to the airline ticket;
    • flight number – according to the airline ticket;
    • departure date – according to the airline ticket;
    • transportation route – according to the airline ticket.
  5. The decision on payment of the insurance indemnity shall be issued no later than 15 days from the date of submission of all supporting documents.

2. SUBJECT MATTER OF INSURANCE, PROCEDURE FOR CONCLUDING THE INSURANCE CONTRACT

  1. The subject matter of insurance is the Beneficiary's property interests, which do not contradict the legislation of the Republic of Moldova and which relate to the possession, use and disposal of the Baggage during its transportation by air carriers in accordance with the airline ticket.
  2. The Insurance Contract is concluded for one transportation of Baggage.

3. INSURED RISKS

  1. In accordance with the Insurer's Terms and Conditions, under the Insurance Contract, the Insurer shall provide compensation for damage caused to insured travel Baggage as a result of the following risks during the Insurance Period:
    • Loss, destruction or damage of Baggage while in the custody of the carrier (the period from the time of boarding, confirmed by the transportation company, until the Baggage is collected from the transportation company during an air journey);
    • Theft of Baggage by breaking and entering or through acts of robbery, as confirmed by the competent state authorities.

4. VALIDITY OF THE CONTRACT

  1. The validity period of the Insurance Contract shall be the period during which the Baggage is transported by air carriers in accordance with the airline ticket.
  2. The Insurer's liability begins when the Baggage is handed over to the transportation organization at the point of departure and continues throughout the entire transportation period (including, by agreement of the parties, the time required for reloading and transshipment, as well as storage in warehouses at reloading and transshipment points) until the Baggage arrives at the destination.
  3. The Insurance Policy is an integral part of the Insurance Contract.

5. SUM INSURED

  1. Under the Insurance Contract, Baggage is insured within the limits of the Insurer's liability.
  2. The maximum compensation limit is EUR 1,450 per person per event and in total for the Insurance Period, as follows:
    • Lost Baggage – compensation of EUR 20/kg shall be paid, up to a maximum of 25 kg;
    • Stolen Baggage – compensation of up to EUR 450 shall be paid, depending on the market value of the items contained in the respective Baggage;
    • Damaged Baggage – compensation of up to EUR 250 shall be paid, depending on the market value of the items contained in the respective Baggage. The Beneficiary is required to provide supporting documents (receipt, invoice, signed and stamped cash register receipt, etc.) confirming the BENEFICIARY's ownership of the goods contained in the Baggage declared lost.
  3. No deductible shall apply.

6. INSURANCE PREMIUMS

  1. The insurance premium shall be EUR 2.
  2. The insurance premium shall be paid in full upon conclusion of the Insurance Contract by bank transfer or in cash at the cashier's office in MDL, according to the official exchange rate established by the National Bank of Moldova on the date of payment.

7. RIGHTS AND OBLIGATIONS OF THE PARTIES

  1. The Insurer shall:
    • inform the POLICYHOLDER / INSURED / BENEFICIARY of the Insurance Terms and Conditions;
    • provide insurance coverage for the transported Baggage in accordance with the Terms and Conditions and the applicable legislation of the Republic of Moldova;
    • not disclose information regarding the POLICYHOLDER / INSURED / BENEFICIARY and their financial situation, except in cases provided for by the legislation of the Republic of Moldova;
    • upon the Beneficiary's right to receive insurance compensation arising, make the payment within 30 days from the date the Beneficiary submits all documents, in the amount determined as a result of the completed investigation.
  2. The Insurer shall have the right to partially or fully refuse compensation for the loss or damage in the cases provided for by the Insurance Terms and Conditions and the Insurance Contract.
  3. The POLICYHOLDER / INSURED shall:
    • pay the insurance premium established by the Insurance Contract to the Insurer on time;
  4. The BENEFICIARY shall:
    • upon the Insurer's request, provide any documents confirming the transportation of the cargo during the validity period of this Contract;
    • inform the Insurer of all insurance contracts concluded or in the process of being concluded in respect of the respective subject matter of insurance;
    • transfer to the Insurer the right of subrogation;
    • immediately upon becoming aware of it, inform the Insurer of any event indicating the characteristics of an insured event.
  5. The BENEFICIARY shall have the right to:
    • receive insurance compensation, provided that all provisions of the Insurance Contract and the Insurance Terms and Conditions have been complied with.

8. BENEFICIARY'S ACTIONS UPON THE OCCURRENCE OF AN INSURED EVENT

  1. Upon the occurrence of an insured event, the BENEFICIARY shall:
    • personally and immediately report to the Lost Baggage Office at the airport if, after disembarkation, the Baggage cannot be found in the designated baggage reclaim area;
    • complete the special forms with the requested information (personal data, itinerary, baggage details) for the purpose of recovering the travel Baggage;
    • notify the competent state authorities immediately or as soon as possible, but no later than 24 hours after the occurrence of the event, if they are the victim of Baggage theft;
    • in the event of an event insured under the Policy, the BENEFICIARY shall notify the Insurer within 48 hours of the occurrence of the insured event or within 3 working days from returning to the country;
    • provide the Insurer with all information known to them regarding the occurrence of the insured event and make available any document in their possession relating to the event.

9. ESTABLISHMENT, ASSESSMENT AND PAYMENT OF INSURANCE COMPENSATION

  1. The amount of compensation shall not exceed the compensation limit established by the Insurance Contract, based on the supporting acts/documents;
  2. The BENEFICIARY may claim compensation for stolen Baggage only if the Baggage has not been recovered within 30 days from the date of occurrence of the insured event. If the Baggage is subsequently recovered after the insurance compensation has been paid, the BENEFICIARY shall notify the Insurer and return the insurance compensation received within a maximum of 10 days from the date of recovery.
  3. The claim for insurance compensation shall be accompanied by the following documents:
    • the BENEFICIARY's statement regarding the occurrence of the insured event;
    • the form completed at the baggage claims office of the destination airport (Lost&Found);
    • the transportation ticket for the journey during which the insured events occurred, together with the baggage claim tag relating to the Baggage involved in the insured event;
    • in the event of lost Baggage: written notification from the transportation company stating that it has stopped searching for the Baggage and considers it permanently lost;
    • in the event of Baggage theft: a document confirming registration of the incident and a copy of the complaint filed by the BENEFICIARY with the competent state authorities;
    • the Insurance Policy;
    • any other documents necessary for the settlement of the claim.
  4. If the theft, loss or damage of the Baggage constitutes an insured event under this Contract, the Insurer shall pay the amounts due within 15 working days from the date of submission of the last document necessary for the settlement of the claim file.

10. EXCLUSIONS FROM INSURANCE COVERAGE AND LIMITATION OF THE INSURER'S LIABILITY

  1. In addition to the exclusions provided for in the Insurance Terms and Conditions for transported cargo, the Insurer shall also not provide compensation for:
    • Baggage intended for the transportation of items with a combined weight of less than or equal to 5 kilograms, such as shoulder bags, belt bags, handbags, shopping bags and plastic bags;
    • Baggage that is not transported on the same journey as the BENEFICIARY;
    • the theft/loss of Baggage in the territories of countries where the BENEFICIARY holds citizenship, permanent residence or residence status;
    • any claim for compensation in connection with the occurrence of insured events where the BENEFICIARY has failed to file a complaint with the transportation company within a maximum of 24 hours from the time the event was discovered and for which no official written report has been issued;
    • fragile items, cash or coins of any nature or type (including collections or individual items of numismatic value), cheques, securities and bonds of any kind, documents, travel tickets, stamp collections and jewellery, paintings, sculptures, precious objects, watches, objects of material, artistic, scientific or historical value in general, as well as any materials or objects whose transportation is not permitted under passenger transportation regulations;
    • the contents of Baggage consisting of fur garments, food/perishable products, winter sports equipment, items used in specialized fields, such as medical equipment, technical items or accessories, professional equipment, electronic devices, musical instruments, mobile phones, contact lenses, prostheses/orthoses;
    • delays in the recovery of Baggage in situations where the BENEFICIARY is not permitted to continue travelling (is denied boarding or is removed from the aircraft before take-off/departure) after having checked in the Baggage for transportation;
    • Baggage detained by authorities, delays in the delivery of Baggage due to actions of the police/customs authorities or other bodies authorized to detain it;
    • Baggage stolen as a result of the BENEFICIARY's negligence;
    • Baggage left unattended in open areas (balconies, corridors, terraces);
    • damage caused by strikes of employees of the transportation company, airports/bus stations/railway stations/ports, security agents or customs officers;
    • financial losses and consequential damages (for example, loss of use of property).

11. SETTLEMENT OF DISPUTES

  1. All claims and disputes between the Insurer and the POLICYHOLDER / INSURED / BENEFICIARY shall be settled through negotiations.
  2. If negotiations between the parties fail, all claims and disputes between the Insurer and the POLICYHOLDER / INSURED / BENEFICIARY shall be settled in accordance with the legislation of the Republic of Moldova.
  3. Claims may be submitted within the limitation period established by the legislation of the Republic of Moldova, starting from the moment the right of subrogation arises.
